Marketplace Terms
What governs a sale on Hangar Bay. Written to be read once and understood, because the moment you need to know what you agreed to is the worst moment to be reading it for the first time.
Version 1.0. These are the Marketplace Terms in force. We record which version you accepted and when. If the wording changes, the version changes with it and you are asked again, rather than being quietly held to wording you never saw.
1. Who this is between
A sale on Hangar Bay is a contract between the buyer and the seller. Hangar Bay is a registered business name of Equipoised Enterprises Pty Ltd, ABN 49 692 667 986, of 32A Aldinga Beach Rd, Aldinga Beach SA 5173.
That company is not a party to the contract of sale between you and the person you are dealing with. It does not own the gear at any point and does not supply it. It does supply the marketplace itself, and where a sale runs through Escrow.com it also acts as broker on that transaction. Those are real services and we are responsible for them, which is a different question from who is selling you a canopy. Section 9 says what that responsibility covers.
2. How you accept these terms
You accept these terms when you tick to accept them: at sign-up, when you publish a listing, and when you make an offer. We record the version, the wording shown, the moment, and which of those actions it was. You must be at least 18 and able to enter a contract.
If you had an account before these terms came into force, you are asked at your first listing or offer rather than being treated as having agreed to something that did not exist when you signed up.
3. The gear
A seller who misdescribes gear is responsible for that, to the buyer, under the general law and under Australian Consumer Law where it applies. That responsibility sits with the seller, not with Hangar Bay.

6. What you agree to as a seller
- You own the gear outright and have the right to sell it. It is not stolen, and it is not subject to finance or any registered security interest.
- Serial numbers are accurate, and damage, repairs and modifications are disclosed.
- Photos are of the actual item, and they are yours to publish.
- You will not advertise or offer test jumps as a way to inspect gear before purchase.
- On a cross-border sale you will declare it honestly: no undervaluing, no marking a sale as a gift, no describing a purchase as a repair.
7. What you agree to as a buyer
- You understand that a sale settled directly between you and the seller carries no payment protection from Hangar Bay, and you are choosing how to pay accordingly.
- Before you fly gear you have bought, you will have it checked by a rigger. Flying it is not an inspection. On an Escrow.com sale, flying it will normally end the inspection window, and a problem raised after that is very hard for anyone to act on.
- You will not push a seller to move the conversation off-platform.
8. Your photos and your information
Your listing photos stay yours. By publishing them you give us permission to display and share them for the purpose of running the marketplace and showing your listing, including in search results and in the Escrow.com checkout for your own sale. That permission ends for new uses when the listing comes down.
Completing a sale means the two of you exchange what a delivery needs, including a name and address. If a Canopy Passport is attached, completing the sale transfers that wing's logbook to the buyer, because the record belongs with the wing. Your own jump records and your account stay yours and do not move. Our Privacy Policy covers the rest.
9. What we are responsible for, and what we are not
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. That includes the guarantees that apply to our own supply of the marketplace and the broker service.
Beyond those, and to the extent the law allows: we provide the marketplace as it is, we do not promise it will be uninterrupted or error free, and we are not responsible for the conduct of the people who use it or for the gear they sell. Where we are liable for failing to meet a consumer guarantee in supplying our own service, our liability is limited to supplying that service again or paying the cost of having it supplied again.
We can remove a listing, suspend or close an account, and pass on a report of stolen or misrepresented gear, on any sale regardless of how it was paid for. We cannot reverse a payment we were never part of. See support.
10. What is not sold here
The prohibited-items list on the selling page is part of this agreement as it stands at the version above: used single-use safety parts, used AAD cutters and pyrotechnic items, rigger seal presses, smoke products, gift cards, and anything not owned outright by the seller.
